Settling taxes with works of art: how payment in kind functions

Revised on 20 October 2026. This guide is for information purposes and does not constitute tax advice. If you identify an error, please contact me.

Payment in kind (dación en pago) allows for the discharge of certain tax debts through the delivery of assets from the Spanish Historical Heritage. It is not a general method for settling any tax with any work of art, nor is it a right that the Administration is compelled to accept.

1. Which debts can be settled in this manner

Law 16/1985 provides this route for debts regarding:

  • Personal Income Tax.
  • Corporate Income Tax.
  • Wealth Tax.
  • Inheritance and Gift Tax.

The specific laws governing these taxes and the collection regulations complete the regime. Before initiating the procedure, confirm the competent administration: part of the Inheritance and Gift Tax and the Wealth Tax is devolved to the autonomous communities.

2. Which assets can be delivered

Article 73 refers to assets registered in the General Register of Assets of Cultural Interest or included in the General Inventory of Movable Assets. A valuable work lacking such protection is not automatically covered.

Information from the Ministry allows for the request of an assessment of assets not yet registered. This does not eliminate the legal requirement to finalise the payment in kind: it may be necessary to process their inclusion. Consult the specific applicability before relying on this route.

3. Two coordinated procedures

In practice, one must engage with:

  • The competent collection body, requesting payment in kind within the applicable period.
  • The Ministry of Culture, for the valuation and the report on the interest of the asset.

The mere submission of a request does not suspend the debt. Verify its effects on the payment period, interest, guarantees and any potential enforcement proceedings.

4. Documentation

Prepare:

  • Proof of ownership and, where applicable, registration or inventory.
  • Identification, photographs, technique, dimensions, authorship and condition.
  • Provenance and historical documentation.
  • Proposed valuation and its supporting grounds.
  • Tax, debt and collection body.

The guide on how to value a work of art assists in organising the file, although the definitive valuation rests with the public procedure.

5. Who values and who decides

The advisory board on the classification, valuation and export of heritage assets (Junta de Calificación, Valoración y Exportación) provides a report on the asset and its value. The valuation opinion remains valid for the period indicated by the Ministry and does not oblige the interested party to deliver the work. Acceptance rests with the competent collection body and must also consider the public interest of the acquisition. The cultural report does not render acceptance automatic.

6. Fiscal effects and value difference

The Personal Income Tax Act declares exempt the capital gain that may arise on the occasion of these payments in kind under the terms of article 73 of Law 16/1985.

Do not assume that you will receive funds if the asset is valued higher than the debt. Payment in kind is a means of settlement, not an ordinary sale. Before submitting the request, seek an express response regarding the valuation allocation, the possibility of partial delivery and any excess.

7. Example

A family inherits a painting included in the General Inventory and must address the Inheritance Tax. They may request payment in kind within the deadline and promote the cultural valuation. The debt will only be extinguished to the extent and at the time determined by the acceptance resolution. If the work is rejected, it must be paid through another means.

Checklist

  • The tax legally permits payment with cultural assets.
  • I have identified which administration collects the debt.
  • The asset is registered or I have clarified how to process its inclusion.
  • I am submitting the request within the deadline.
  • I am aware of the status of the debt while it is being resolved.
  • I have enquired how a difference between value and debt is handled.
  • I have a liquidity plan if the work is not accepted.
