A donation does not begin by taking the work to the museum. It begins by verifying whether it fits within their collection and by submitting sufficient information. The institution may reject it due to a lack of relevance, duplication, costs, condition, rights, or conservation capacity. There is no right to acceptance or exhibition.
Select the institution
Review the mission, collection, territorial, chronological and technical scope, acquisition policies, and contact details. Do not send the same proposal indiscriminately.
Initial contact
The Ministry indicates that the individual must contact the museum so that it may assess suitability and interest. The Museo del Traje recommends an initial consultation with a description and images before the formal procedure. Do not hand over the work without instructions and a receipt.
What to submit
- a brief letter;
- owner and contact details;
- authorship, title, date, technique, and dimensions;
- images and condition;
- provenance and authenticity;
- location;
- rights, encumbrances, and restrictions;
- reason for the proposal;
- conservation and installation requirements.
For digital works, include files, versions, dependencies, accounts, and the possibility of transfer.
Ownership and provenance
Gather invoices, contracts, inheritance documents, certificates, publications, and movement records. Physical possession alone does not prove ownership or exploitation rights. Declare any doubts or gaps.
Evaluation and acceptance
The museum assesses relevance, quality, authenticity, provenance, condition, space, costs, rights, and collection policy. In state museums, a positive assessment initiates the processing by the Ministry; it does not yet equate to acceptance.
Different modalities
Distinguish between donation, sale, deposit, loan, legacy, and dation. Do not refer to a temporary or conditional delivery as a donation.
Conditions
Museums may reject conditions that limit conservation or availability. The Museo del Traje, for example, does not accept the obligation of permanent exhibition. For certain tax benefits, the donation must be irrevocable, pure, and simple.
Ownership and rights
Transferring the medium does not automatically transfer reproduction, distribution, public communication, or transformation rights. If the donor is the author, formalise the uses. If not, they cannot assign the rights of others.
Delivery
If accepted, formalise the document, inventory, condition, packaging, transport, insurance, receipt, and date. The Museo del Traje requires a written statement and a delivery certificate. A provisional receipt is not always definitive acceptance.
Technological work
Include code, masters, licences, instructions, components, services, and an obsolescence strategy. Acceptance of the medium does not guarantee the capacity to maintain the system.
Taxation
Not every donation generates a deduction. It depends on the donor, the recipient, the nature of the asset, and the requirements. Verify this with professional advice.
If rejected
Retain the file and evaluate another institution, archive, university, or legacy plan. Rejection is not an absolute valuation of the work.
