Registering as an artist with the tax authorities: group 861 and form 036

Revised on 7 November 2026. Should any information have changed, please notify me and I shall update it.

The tax authorities do not ask if you are an artist. They ask what activity you perform, from when, and under which VAT regime. These answers are provided in form 036, where you must select a heading from the Tax on Economic Activities. For those who paint, sculpt, engrave, work with ceramics, or develop a comparable visual practice, group 861 is usually the starting point in the second section. The heading is followed by periodic obligations and, through a separate channel, Social Security. This is general information, not tax advice.

When registration is required

The obligation to register for tax purposes arises upon the commencement of an economic activity. Regulations do not establish a sales threshold below which one may operate without registration. An isolated sale to an acquaintance does not render one a professional. Selling in an organised manner, with price lists, a website, commissions or a gallery that represents you, points the contrary. Between these two extremes lies a grey area dependent upon specific facts; for such cases, a consultation with an advisor is less costly than a subsequent regularisation.

The census declaration for registration must be submitted prior to commencement. The start date you declare determines the point at which your VAT and personal income tax obligations begin; therefore, do not advance it for convenience, nor delay it to gain time.

The tax classification

The IAE rates, approved by Royal Legislative Decree 1175/1990, have three sections: business, professional, and artistic activities. The name of the third section confuses many people. The 'artistic' section covers performance and entertainment activities, such as cinema, theatre, circus, music, or dance. Visual arts are in the second section, for professional activities, within grouping 86.

Group 861. Includes painters, sculptors, ceramists, artisans, engravers, and similar artists. Classification depends on the activity actually performed, not the 'artist' label, and the Directorate General for Taxes interprets this broadly: in binding consultation V2556-21, it even classified the activity of an author of books under group 861. When production ceases to be manual and becomes mass-produced, the activity may correspond to a heading in the first section.

Group 862. Restorers of works of art.

I have not located a binding consultation that assigns a heading to the sale of native digital work, whether it is a file, a generative piece, or a token. If the work is yours and you sell it as your own work, the reasoning of that consultation points to 861. That conclusion is mine; no consultation supports it yet.

A single individual may require more than one classification, for instance, if they combine creation, teaching, publishing, or mass production. Should you also publish your own books, the same ruling requires additional registration under classification 476.1 of the first section, 'Book publishing'. The sale of mass-produced products derived from your imagery may present the same issue: industrial reproduction is not the work itself.

Form 036, and the 037 that no longer exists

Since 3 February 2025, there is only one form: Order HAC/1526/2024 abolished the 037, the simplified census declaration used by many individuals. Tutorials recommending it are still circulating. Ignore them.

In form 036, you declare your identification details, your tax address and, if you have one, that of your studio; the activity and its heading; the start date; the VAT regime, which for a visual artist is the general one; and the method for estimating income for personal income tax purposes. It is submitted via the Tax Agency's electronic office using a certificate, Cl@ve, or electronic ID.

The classification is declared, yet the tax is not paid: natural persons are exempt from the IAE (Tax on Economic Activities).

Periodic obligations

Census registration entails periodic obligations with their own specific calendar.

Regarding VAT, form 303 is submitted quarterly, alongside the annual summary form 390. The supply of a work by its author is generally taxed at 10%; the assignment of copyright by a natural person who is a visual artist may be exempt; and workshops, reproductions, and other services are typically taxed at 21%. Further details are available in the guide on how to invoice the sale of artwork.

For personal income tax, quarterly instalment payments are made using form 130, unless at least 70% of the income from the activity in the previous year was subject to withholding. Those who sell primarily to private individuals, who do not withhold, rarely reach that percentage. Those who invoice companies and professionals are subject to a 15% withholding, or 7% in the cases explained in the invoicing guide.

You must maintain record books for income, expenses, and investment assets. If you invoice using software, consult the Verifactu and electronic invoicing calendar, which has its own dedicated guide on this site.

Social Security is a separate matter

Registering with the tax authorities does not register you with Social Security. These are distinct procedures with different bodies. The Special Regime for Self-Employed Workers includes anyone who carries out an economic activity on their own account in a habitual, personal, and direct manner. According to the General Treasury, the application must be submitted before starting and no more than 60 calendar days prior to the start date.

Habituality is the point of contention. For years, the courts have used the attainment of income exceeding the annual minimum wage as an indicator. This is a judicial criterion without reflection in the regulations, and the Treasury is not obliged to apply it to your specific case.

I have not identified a regulation that mandates an order between census registration and registration with the RETA (Special Regime for Self-Employed Workers). Both must be completed prior to commencement. In practice, having already obtained the tax classification facilitates the application to the Social Security office.

Five avoidable errors

Choosing the third section because it is called 'artistic'. Submitting an 037 downloaded from an old website. Registering with the tax authorities and forgetting Social Security, or vice versa. Applying 10% VAT to everything, including workshops and prints. And leaving the start date blank or setting it at random, when the first quarter to be declared depends on it.

On the open conversation

If you have selected a different classification and the tax authorities have accepted it, or if you possess a binding ruling regarding digital work, your case may improve this guide. This notebook remains open to those who advise artists and those who have recently registered.
